TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement, the Listing Agreement prevails for listing specifics.

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile apps and related websites within our network. You must be at least 18 years old. We may modify these Terms at any time; continued use after changes take effect constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms — house and land listings, off-the-plan properties, new developments, boutique property showcases, school-zone information, property calculators, mortgage broker connections, and business directory services.

HALP is an information and advertising platform. We facilitate connections between property seekers and property providers. We are not a real estate agent, developer, builder or financial advisor.

Lead routing — property listing enquiries go directly to the listing agent, developer or builder (HALP does not store or process these). Platform enquiries via Contact Us, Join Us and Advertise With Us are managed by HALP under our Privacy Policy.

Services are provided "as is" and "as available". Infrastructure includes AWS, Google Workspace, Stripe, Pipedrive, ActiveCampaign and Zapier.

3. User Accounts and Registration

You must provide accurate information and be at least 18. You are responsible for account security and all activity under your account. We may suspend or terminate accounts for breaches, false information, fraud, non-payment or extended inactivity.

4. User Conduct and Prohibited Activities

You must comply with all laws, use services only for lawful purposes, and act in good faith. You must not misuse the platform (bots, scraping, unauthorised access), post harmful content, engage in illegal activities, harass others, or engage in commercial misuse (reselling services, competing scraping, multiple accounts).

Violations may result in account suspension, content removal, legal action, referral to authorities, and permanent bans.

5. Property Listings and Information

Property listings and information are provided by third parties (developers, builders, agents, project marketing companies, data providers). HALP does not own or verify all listing information. Information may change without notice — always verify critical information directly with the property provider before making decisions.

School zone information is sourced from government databases and provided for reference only. Always verify catchment zones with the relevant education department and individual schools — living in a catchment does not guarantee enrolment.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN, comply with applicable laws, provide accurate information, and hold necessary licences. Listings must accurately describe your services, use your own business name/logo, and comply with Australian Consumer Law. Prohibited business activities include promoting illegal goods, false claims, discriminatory content and IP infringement.

Free listings offer basic presence. Premium subscriptions offer enhanced visibility with monthly or annual payment and auto-renewal until cancelled.

7. Payment Terms (Advertiser Subscriptions)

Pricing is displayed on our website or in the applicable Listing Agreement and is subject to change with 30 days notice. All fees are in AUD, exclusive of GST unless otherwise stated. Standard payment processing fees are included unless we state otherwise.

Payments are processed via Stripe (PCI-DSS Level 1 certified). Auto-renewal applies to subscriptions until cancelled. Cancellation takes effect at the end of the current billing period — no partial refunds for unused time. Pro-rata refunds apply for technical issues preventing service access, processed within 14 business days.

If payment fails, service may be suspended after 7 days and listings removed after 14 days. You remain liable for unpaid fees.

8. Intellectual Property Rights

All content on our platforms is owned by HALP or licensed to us — including "HALP", "House And Land Packages", "Boutique Developments", designs, software, text, graphics and databases. You have a limited, non-exclusive, non-transferable, revocable licence to use the platform for personal, non-commercial purposes.

By submitting user content (reviews, testimonials, forum posts) you retain ownership but grant us a worldwide, royalty-free licence to use, reproduce and display that content, including in marketing materials.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, investment, legal, tax or real estate advice. Calculators provide estimates only. Always consult a licensed adviser.

We do not guarantee data accuracy, continuous service availability, error-free operation, absence of malicious code, or the conduct of third parties on our platform.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, incidental, special or consequential damages arising from your use of our services. Where liability cannot be excluded, total liability is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid in the prior 12 months. Nothing excludes rights under the Australian Consumer Law.

You agree to indemnify HALP against claims arising from your breach of these Terms, violations of law or third-party rights, your use of our services, content you submit, and your interactions with others.

11. Dispute Resolution

Before legal action, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction in NSW courts. Optional arbitration in Sydney is available under ADRA rules. Class actions are waived to the extent permitted by law.

Property listing enquiries go directly to the advertiser — HALP does not store, read or process them. Platform enquiries (Contact Us, Join Us, Advertise With Us) are managed by HALP under our Privacy Policy.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. Invalid provisions will be limited or eliminated; the rest continue in force. Our failure to enforce a provision does not waive future enforcement. You may not assign these Terms without our consent. 13. Special Terms for Specific Services

Mortgage calculators provide estimates only — not pre-approvals. School zone data may change and is for reference only. Property alerts are sent based on your saved searches; you can modify or cancel anytime. HALP may receive a referral fee from brokers we connect you with — brokers are independent third parties.
